Divorces
Divorce is never easy, but with the right legal support, you can move forward with confidence and clarity. At Z&W Law Firm, we represent individuals across New York State in contested and uncontested divorces, helping clients protect their rights, finances, and families during one of the most emotionally and legally complex times in life.
New York is a “no-fault” divorce state, which means you can file for divorce based on the irretrievable breakdown of the marriage for at least six months—without needing to prove fault such as adultery or abuse. However, other grounds still exist if fault-based claims are needed.
We guide clients through all aspects of divorce, including:
- Uncontested Divorce – Where both spouses agree on all terms; often quicker and more cost-effective.
- Contested Divorce – Where disputes exist over issues like custody, property division, or spousal support.
- Child Custody & Visitation – Ensuring that parenting arrangements serve the best interests of the child.
- Child Support – Calculated based on income, custody, and state guidelines.
- Spousal Maintenance (Alimony) – Determining fair financial support based on the length of the marriage, income differences, and contributions.
- Division of Property & Debts – New York follows “equitable distribution,” meaning assets and debts are divided fairly, though not always equally.
How do I start a divorce in NY?
File a Summons with Notice (and often a Complaint) in the Supreme Court of the county where either spouse resides. The other spouse must be personally served.
Can I file without fault?
Yes. NY’s no-fault divorce, based on six-month irretrievable breakdown, is now the most common ground used.
What about residency?
One spouse must have lived in NY for one year (with additional criteria) or two years (no other connection), or both must live here and grounds must have occurred here.
How long does it take?
An uncontested, no-fault divorce may be finalized in 6–8 months after filing. Contested divorces, with disputes over finances, custody, or support, can extend from 1–3 years or more.
