How do I start a divorce in NY?

File a Summons with Notice (and often a Complaint) in the Supreme Court of the county where either spouse resides. The other spouse must be personally served.

Yes. NY’s no-fault divorce, based on six-month irretrievable breakdown, is now the most common ground used.

One spouse must have lived in NY for one year (with additional criteria) or two years (no other connection), or both must live here and grounds must have occurred here.

An uncontested, no-fault divorce may be finalized in 6–8 months after filing. Contested divorces, with disputes over finances, custody, or support, can extend from 1–3 years or more.
