New York is a “no-fault” divorce state, which means you can file for divorce based on the irretrievable breakdown of the marriage for at least six months—without needing to prove fault such as adultery or abuse. However, other grounds still exist if fault-based claims are needed.

How do I start a divorce in NY?
File a Summons with Notice (and often a Complaint) in the Supreme Court of the county where either spouse resides. The other spouse must be personally served.
Can I file without fault?
Yes. NY’s no-fault divorce, based on six-month irretrievable breakdown, is now the most common ground used.
What about residency?
One spouse must have lived in NY for one year (with additional criteria) or two years (no other connection), or both must live here and grounds must have occurred here.
How long does it take?
An uncontested, no-fault divorce may be finalized in 6–8 months after filing. Contested divorces, with disputes over finances, custody, or support, can extend from 1–3 years or more.
